1. Agreement to Terms
By accessing or using PostCrew ("the Service", "PostCrew"), operated by Group Taiga("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
These Terms apply to all visitors, users, and other parties who access or use the Service.
2. Description of Service
PostCrew is an AI-powered social media content management and publishing platform that enables users ("Users", "Customers") to:
- Create and manage brand profiles and brand DNA records;
- Generate marketing content (text, images) using third-party AI providers (Anthropic, OpenAI, Google);
- Connect social media accounts (Instagram, Facebook, LinkedIn, X, TikTok) and publish content;
- Schedule, queue, and review automated publishing.
3. Account Registration & Eligibility
To use PostCrew you must be at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a binding contract. By creating an account you confirm you meet these requirements.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at developer@grouptaiga.com of any unauthorized use.
4. Connected Social Media Accounts
When you connect a Meta (Facebook/Instagram), LinkedIn, X, or TikTok account to PostCrew, you authorize us to publish content, read profile metadata, and perform actions on your behalf within the scopes you grant during OAuth.
You remain solely responsible for the content published through your connected accounts and for compliance with each platform's terms (including Meta Platform Terms, LinkedIn API Terms, X Developer Agreement, TikTok Developer Terms).
You may disconnect any social account at any time from the dashboard. Disconnection revokes our publishing access; we do not retain the OAuth token after disconnection.
5. User Content & License
You retain ownership of all content you upload, generate, or publish via PostCrew ("User Content"), including brand assets, captions, images, and AI-generated outputs derived from your prompts.
You grant PostCrew a limited, non-exclusive, royalty-free, worldwide license to host, store, process, transmit, and display User Content solely for the purpose of operating and providing the Service to you. This license terminates when you delete the User Content or close your account.
You represent and warrant that you own or have all rights necessary to use the User Content, and that the User Content does not infringe on any third-party intellectual property, privacy, or publicity rights.
6. AI-Generated Content Disclaimer
PostCrew uses third-party AI services (Anthropic Claude, OpenAI GPT, Google Gemini) to generate content. AI outputs are probabilistic and may contain inaccuracies, biases, or inappropriate material. You are solely responsible for reviewing, editing, and approving any AI-generated content before publishing it to your social accounts or distributing it elsewhere.
We do not claim ownership of AI outputs generated based on your inputs, subject to the terms of the underlying AI providers.
7. Prohibited Conduct
You agree not to use the Service to:
- Publish content that is unlawful, harmful, threatening, harassing, defamatory, obscene, pornographic, hateful, or otherwise objectionable;
- Infringe on intellectual property, trademark, privacy, or publicity rights of any third party;
- Generate or distribute spam, malware, phishing, or fraudulent content;
- Attempt to gain unauthorized access to PostCrew systems, other users' accounts, or third-party platforms;
- Reverse engineer, decompile, or extract source code from the Service;
- Use the Service in violation of any applicable law or any connected social platform's terms.
8. Pricing & Payment
PostCrew may offer free and paid plans. Paid plan terms, billing cycles, and refund policies are presented at the point of purchase. We reserve the right to modify pricing with 30 days notice via email or dashboard notification.
9. Service Availability & Modifications
We strive to maintain Service availability but do not guarantee uninterrupted operation. We may modify, suspend, or discontinue features at our discretion, with reasonable notice when practicable.
10. Termination
You may terminate your account at any time by emailing developer@grouptaiga.com or via the dashboard.
We may suspend or terminate your account immediately, without notice, if you violate these Terms, abuse the Service, or jeopardize the security of other users or third-party platforms.
Upon termination, your right to use the Service ceases. Sections 5 (license post-deletion), 6, 7, 11, 12, and 13 survive termination.
11. Disclaimer of Warranties
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.
12. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Group Taiga, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of or inability to use the Service.
Our total liability for any claim arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or €100, whichever is greater.
13. Indemnification
You agree to indemnify and hold harmless Group Taiga from any claim, damage, liability, or expense (including reasonable attorneys' fees) arising from your User Content, your use of the Service, or your violation of these Terms or third-party rights.
14. Governing Law & Disputes
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict of law provisions. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul.
15. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via dashboard notification or email at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
